Family Based Immigration

        Immigration to the United States through a relative already based in United States is the simplest route with both the shortest and longest time, depending on if you are an immediate family member (Parents, spouse and minor children) or adult children or siblings of the U.S. citizen or a non-citizen’s spouse and adult children.

        Immigration to the United States through a relative already based in United States is the simplest route with both the shortest and longest time, depending on if you are an immediate family member (Parents, spouse and minor children) or adult children or siblings of the U.S. citizen or a non-citizen’s spouse and adult children.

        The United States immigration laws allows both the citizens and Green Card holders of the United Sates to sponsor immigration of their spouses, siblings and children.   Children, spouse and parents of a U.S. citizens are immediate relatives—they can apply for and receive an immigrant visa as soon as their application is approved.  However, the Green Card holder, called, the Lawful Permanent Resident can only sponsor his/her spouse and children for immigration and not the parents. Also, for both categories, the Citizens and Green Card holders, the children must be under the age of 21 to qualify as an “immediate relative” of a U.S. citizen, or as the principal beneficiary of a Green Card holder’s petition.  The other adult children and other family member entitled to immigrations benefits are those who are not “immediate relative,” falling into four distinct categories (1) the spouses and unmarried, minor (under 21) children of Green Card holders), (2) the unmarried, adult (21 or over) sons and daughters of Green Card holders, (3) the married sons and daughters of U.S. citizens, and (4) the brothers and sisters of U.S. citizen. Collectively these four categories entitled to immigration are grouped according to their priority of preferences given by United States. These preferences based immigration are notorious in terms of their time. The said family-sponsored immigrant may suffer inordinate delay before their visa becomes available to them.
